Petitions for IPR on ParkerVision 012 Patent and 940 Patent Instituted for Trial
JACKSONVILLE, Fla., March 09, 2016 -- ParkerVision, Inc. (NASDAQ:PRKR), a leading developer and marketer of radio frequency technologies used in advanced wireless solutions, announced today that the Patent Trial and Appeal Board ("PTAB") has issued its decisions with regard to the petitions for Inter Partes review ("IPR") filed by Qualcomm Inc. and Qualcomm Atheros, Inc. (collectively "Qualcomm") against various claims of three ParkerVision patents.
The PTAB denied all petitions for IPR against the claims Qualcomm challenged for ParkerVision's U.S. Patent 7,039,372 (the ‘372 Patent). The PTAB instituted the petitions for IPR against the claims challenged for ParkerVision's U.S. Patent 6,091,940 (the ‘940 Patent) and Patent 7,966,012 (the ‘012 Patent).
The ‘372 and the ‘940 Patent are among the patents asserted in the district court case against Qualcomm, Samsung and HTC (6:14-cv-00687) which is currently stayed pending the results of the Company's proceedings at the U.S. International Trade Commission. The ‘012 Patent was recently removed from the district court case in a joint agreement
between ParkerVision and the defendants in order to narrow the scope of the case.
ParkerVision's Chairman and CEO, Jeffrey Parker, commented, "We are pleased with the PTAB's decision to deny institution of IPR proceedings against any of the claims challenged in our ‘372 Patent, including the claims that are asserted as being infringed in our district court case against Qualcomm, Samsung and HTC. It has become common practice for defendants in patent litigation to file IPR challenges with the PTAB against asserted patents with the hopes of invalidating patent claims and therefore avoid infringement. To prevail in a patent lawsuit only a single claim needs to be found infringed and not invalid. We will assess our defense at the PTAB of the other claims for
those patents that were instituted for trial."
ParkerVision, Inc. designs, develops and markets its proprietary radio-frequency (RF) technologies, which enable advanced wireless solutions for current and next generation communications networks. Protected by a highly-regarded, worldwide patent portfolio, the Company's solutions for wireless transfer of RF waveforms address the needs of a broad range of wirelessly connected devices for high levels of RF performance coupled with best-in-class power consumption.
